NoSleepLab is a product line of Mark Studios, LLC, a Florida limited liability company, which publishes these apps and this website and is responsible for this page (“we”, “us”). Contact: contact@markstudios.com · 7901 4th St N, Ste 300, St. Petersburg, FL 33702, USA.

These terms are governed by the laws of the State of Florida, and any dispute will be heard in the state or federal courts for Palm Beach County, Florida. If you are a consumer in the EU or UK, you keep the mandatory protections and courts of your country.

Acceptance of Terms

By downloading, installing, or using any NoSleepLab application ("Apps"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use our Apps.

License

NoSleepLab grants you a limited, non-exclusive, non-transferable, revocable license to use our Apps for personal or commercial purposes on any device you own or control. The iPhone apps, BEAROUT and Watchdog have terms of their own, which apply to them. Where an App is published under an open source license, that license governs and overrides anything on this page that conflicts with it.

Restrictions

These apply only to Apps that are not published under an open source license. You agree not to:

• Redistribute a paid App, or resell it as your own
• Remove or alter any proprietary notices or labels on the Apps

Reading, modifying and building from the published source is the point of publishing it, and nothing here restricts that.

Intellectual Property

All Apps, including their design, code, graphics, and documentation, are the intellectual property of NoSleepLab and are protected by applicable copyright and trademark laws. All rights not explicitly granted are reserved.

Disclaimer of Warranties

The Apps are provided "as is" and "as available" without warranties of any kind, either express or implied. NoSleepLab does not warrant that the Apps will be uninterrupted, error-free, or free of harmful components.

Limitation of Liability

To the maximum extent permitted by law, Mark Studios, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Apps.

Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the Apps after changes constitutes acceptance of the revised terms.
