Watchdog Terms of Use

Applies to the Watchdog application for macOS, published by Mark Studios, LLC.
1. Agreement
These Terms of Use (the "Agreement") are a legal agreement between you and Mark Studios, LLC, a Florida limited liability company ("we", "our", "us"), covering your use of the Watchdog application for macOS (the "App"). By downloading, installing, or using the App you accept this Agreement. If you do not accept it, do not use the App.
You must be old enough to form a binding contract where you live, and to hold the Apple Account used for any purchase.
2. Licence
We grant you a personal, non-transferable, non-exclusive license to use the App on Apple-branded devices you own or control, as permitted by the Apple Media Services Terms and Conditions. You may not sell, rent, sublicense, or redistribute the App; reverse-engineer, decompile, or disassemble it except where that restriction is prohibited by law; or remove any proprietary notices. We keep all rights not expressly granted here.
3. What Watchdog is, and what it is not
Watchdog is a convenience utility that uses your Mac's camera to notice activity in front of it and save what it sees. It is not a security system, an alarm system, or a life-safety device. It depends on your Mac being awake, powered, unobstructed, and running the app. It can miss events, produce false detections, and stop entirely if the machine sleeps, the lid closes, the camera is covered, or macOS revokes camera access. Do not rely on it to protect people or property from harm, and do not use it as your only safeguard against anything that matters.
4. Acceptable use and lawful recording
The App records identifiable images of people. You agree that you will:
- use the App only on a device you own or are authorized to control;
- comply with all laws that apply where you are, including laws on recording, surveillance, notice, consent, employee monitoring, and data protection;
- inform people who may be recorded, where the law requires it or where it is simply the decent thing to do;
- not use the App to monitor anyone covertly, to harass, stalk, or intimidate, or to record in places where people reasonably expect privacy, such as bathrooms, changing rooms, or bedrooms that are not your own.
You are solely responsible for how you use the App and for any consequence of recording other people. We may terminate your license if you breach this section.
5. Subscriptions, pricing, and auto-renewal
Watchdog is free to use with a three-day capture history. Watchdog Pro is an auto-renewing subscription that unlocks unlimited history, video recording, scheduling, the stats dashboard, advanced PDF reports, and the alarm, flash, and screen-dim responses.
- Watchdog Pro Monthly — US$3.99 per month. This plan does not include a free trial.
- Watchdog Pro Annual — US$29.99 per year, including a 7-day free trial for Apple Accounts that have not already used an introductory offer in this subscription group.
Prices are in US dollars and may differ in other storefronts because of local pricing and tax; the price shown in the App at the moment of purchase is the price that applies. We may change prices for future periods, and Apple will notify you and seek your consent where required before a renewal at a higher price.
Free trial. If your Apple Account is eligible, the annual plan begins with a 7-day free trial. Unless you cancel at least 24 hours before the trial ends, it converts automatically into a paid annual subscription and your Apple Account is charged US$29.99. A trial can only be used once per Apple Account in this subscription group.
Auto-renewal. Payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours of the period ending.
Cancelling. Manage or cancel at any time in System Settings → Apple Account → Media & Purchases → Subscriptions, or in the App Store. Deleting the App does not cancel your subscription — you must cancel through Apple. Cancelling stops the next renewal; you keep Pro features until the end of the period you already paid for.
Refunds are handled by Apple, not by us, under the Apple Media Services Terms and Conditions. Request one at reportaproblem.apple.com. We cannot issue, approve, or refuse refunds for App Store purchases.
6. What happens to your captures if Pro ends
The free tier keeps three days of captures. If your Pro subscription lapses or you cancel, that limit applies again, and the next time Watchdog runs it will permanently delete captures older than three days, including the image and video files. This cannot be undone and we cannot recover them, because we never had a copy. Export anything you want to keep before your subscription ends.
7. Privacy
Captures stay on your Mac. Our Privacy Policy explains exactly what is recorded, where it lives, how long it is kept, and how to delete it, and forms part of this Agreement.
8. Disclaimer of warranties
To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that it will detect any particular event. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you, and nothing here limits rights you have as a consumer that cannot be waived.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, property, profits, or goodwill, arising out of or relating to the App — including any failure to detect an event, any missed or false detection, and any loss of captures. Our total liability for any claim relating to the App is limited to the amount you paid for it in the twelve months before the claim arose. Some jurisdictions do not allow these limitations, so they may not fully apply to you.
10. Termination
This Agreement applies until terminated. It ends automatically if you breach it, and you may end it at any time by deleting the App. Sections 3, 4, and 8 through 13 survive termination. Termination of this license does not by itself cancel an App Store subscription — cancel that through Apple as described in section 5.
11. Terms required by Apple
Because the App is distributed through the Apple App Store, the following terms apply and, where they conflict with anything above, they prevail:
- This Agreement is with us, not Apple. It is concluded between you and Mark Studios, LLC only. Apple is not a party to it, and we alone are responsible for the App and its content.
- Scope of license. The license granted in section 2 is limited to a non-transferable license to use the App on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that it may be accessed by other accounts through Family Sharing where enabled.
- Maintenance and support. We are solely responsible for providing any maintenance and support for the App. Apple has no obligation whatsoever to furnish any maintenance or support services for it.
- Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are our sole responsibility.
- Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation, including in connection with the App's use of HealthKit or HomeKit frameworks (which the App does not use).
- Intellectual property claims. If a third party claims that the App or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim.
- Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance of it Apple has the right (and is deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
- Developer contact. Questions, complaints, or claims about the App should be directed to Mark Studios, LLC at hello@markstudios.com.
12. Governing law
This Agreement is governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located in Florida for any dispute arising out of it. Nothing in this section deprives you of the protection of mandatory consumer-law provisions, or the right to bring proceedings in the courts, of the country where you live.
13. General
If any provision of this Agreement is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign this Agreement; we may assign it in connection with a merger, acquisition, or sale of assets. This Agreement, together with the Privacy Policy, is the entire agreement between you and us about the App and replaces any earlier understanding. We may update this Agreement; material changes will be reflected in the date at the top of this page, and continuing to use the App after a change means you accept it.
